LG Is Delhi Boss: High Court

New Delhi: In a major setback for Arvind Kejriwal in his long turf war with the Centre, the High Court today said that the Lieutenant Governor (LG) is mainly in charge of Delhi and Kejriwal government needs his approval for everything.

LG Najeeb Jung questioned the legality of appointment of inquiry to probe DDCA issue.
High court’s verdict came on 11 petitions that arose out of a standoff between the Delhi Government and Lt Governor Najeeb Jung over various decisions, including the power to appoint bureaucrats in the national capital.
The High court said the Lt Governor was the administrative head of the national capital and that AAP government’s argument that he was bound go by state Council of Ministers’ advice was “without substance”.
The court also held that Delhi’s Anti-Corruption Branch had no jurisdiction over Central Government officials.
The High court’s verdict came on 11 petitions that arose out of a standoff between the Delhi Government and Lt Governor Najeeb Jung over various decisions, including the power to appoint bureaucrats in the national capital.
Interpretation of Article 239 AA of the Constitution was in question in the case.
“As from the date of commencement of the Constitution (66th Amendment) Act, 1991 the Union Territory of Delhi shall be called the National Capital Territory) and the administrator thereof appointed under article 239 shall be designated as the Lieutenant Governor,” says Article 239 AA of the Constitution.
Chief Minister Arvind Kejriwal’s government has said it would appeal the order in the Supreme Court.
Kejriwal’s government has claimed that Delhi Government has been unable to function because of the Central Government’s interference in its affairs.
